General Terms and Conditions of Trading Space BV, located in Waalwijk

1. General
1.1 These general terms and conditions apply to all offers from Trading Space / Sweet Collections. The terms and conditions are publicly available and can be found on the Trading Space / Sweet Collections website. We will send you a written copy upon request.
1.2 By completing an order, you agree to the delivery and payment terms. Trading Space / Sweet Collections reserves the right to change its delivery and/or payment terms after the expiration of the order term.
1.3 Unless otherwise agreed in writing, Trading Space / Sweet Collections does not recognize any general or specific terms or conditions of third parties.
1.4 Trading Space / Sweet Collections guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.

2. Delivery
2.1 Delivery will take place while stocks last.
2.2 In accordance with the rules of distance selling, Trading Space / Sweet Collections will fulfill orders within 30 days. If this is not possible (because the item ordered is out of stock or no longer available), or if there is a delay for other reasons, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will receive notification within one month of placing the order, and in that case, they have the right to cancel the order without charge and without notice of default.
2.3 Trading Space / Sweet Collections' delivery obligation will be fulfilled, unless proven otherwise, once the items delivered by Trading Space / Sweet Collections have been offered to the customer once. In the case of home delivery, the carrier's report, including the refusal of acceptance, serves as full proof of the offer to deliver.
2.4 All delivery dates stated on the website are indicative. Therefore, no rights can be derived from these dates.

3. Prices
3.1 Prices will not be increased during the offer period unless legal measures make this necessary or if the manufacturer implements interim price increases.
3.2 All prices on the website are subject to printing and typographical errors. We accept no liability for the consequences of printing and typographical errors.
3.3 All prices on the site are in Euros and include 21% VAT, with the exception of countries outside the EU.

4. Inspection period / right of withdrawal
4.1 In the case of a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the buyer has the right to return (part of) the delivered goods within a legally established period without giving a reason. This period begins when the ordered items are delivered. If the buyer has not returned the delivered items to Trading Space / Sweet Collections after this period, the purchase is final. Before returning the goods, the buyer is obligated to notify Trading Space / Sweet Collections in writing within the statutory period after delivery. The buyer must prove that the delivered goods were returned on time, for example, by means of proof of postal delivery. The goods must be returned in the original packaging (including accessories and accompanying documentation) and in new condition. If the goods have been used, encumbered, or damaged in any way by the buyer, the right of withdrawal as defined in this clause lapses. Subject to the provisions of the previous sentence, Trading Space / Sweet Collections will ensure that the full purchase price, including the calculated shipping costs, is refunded to the buyer within 30 days of receipt of the returned shipment. Returning the delivered items is entirely at the buyer's expense and risk.
4.2 The right of cancellation, as described in the previous paragraph, applies only to the delivered goods and will in no case apply to services, such as telephone subscriptions from the (mobile) network operators offered by Trading Space / Sweet Collections. The general terms and conditions of the latter services, in which Trading Space / Sweet Collections acts only as an intermediary or agent, apply.
4.3 The right of withdrawal does not apply to:
· services whose performance, with the consumer's consent, has begun before the seven working day period
· goods or services whose price is subject to fluctuations on the financial market over which the supplier has no influence
· goods that have been manufactured according to consumer specifications, for example custom work, or that have a clearly personal character
· for goods or services that cannot be returned by their nature, for example for reasons of hygiene or that can spoil or become obsolete quickly
· audio and video recordings and computer software of which the consumer has broken the seal
· the supply of newspapers and magazines; for betting and lottery services

5. Data management
5.1 If you place an order with Trading Space / Sweet Collections, your information will be included in the Trading Space / Sweet Collections customer database. Trading Space / Sweet Collections complies with the Personal Data Protection Act and will not share your information with third parties. See our Privacy Policy.
5.2 Trading Space / Sweet Collections respects the privacy of users of the website and ensures that your personal data is treated confidentially.
5.3 Trading Space / Sweet Collections sometimes uses a mailing list. Each mailing includes instructions for removing yourself from this list.

6. Warranty and conformity

6.1 The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations in force on the date the agreement is concluded.
6.2 Any guarantee offered by the entrepreneur, manufacturer or importer does not affect the rights and claims that the consumer can assert against the entrepreneur under the law and/or the distance contract in the event of a failure to fulfil the entrepreneur's obligations.
6.3 The buyer is obligated to inspect the delivered goods immediately upon receipt. If the delivered item appears to be incorrect, defective, or incomplete, the buyer must immediately report these defects to Trading Space / Sweet Collections in writing (before returning them to Trading Space / Sweet Collections). Any defects or incorrectly delivered goods must and can be reported to Trading Space / Sweet Collections in writing no later than two months after delivery. Returns must be made in the original packaging (including accessories and accompanying documentation) and in new condition. Use after discovery of a defect, damage occurring after discovery of a defect, encumberment, and/or resale after discovery of a defect, will void the right to make a complaint and return.
6.4 If Trading Space / Sweet Collections finds the buyer's complaints to be justified, Trading Space / Sweet Collections will, at its discretion, either replace the delivered goods free of charge or make a written arrangement with the buyer regarding compensation, with the understanding that Trading Space / Sweet Collections' liability, and therefore the amount of compensation, is always limited to a maximum of the invoice amount of the goods in question, or (at Trading Space / Sweet Collections' discretion) to the maximum amount covered by Trading Space / Sweet Collections' liability insurance in the relevant case. Any liability of Trading Space / Sweet Collections for any other form of damage is excluded, including additional compensation in any form whatsoever, compensation for indirect
damage or consequential damage or damage due to lost profits.
6.5 Trading Space / Sweet Collections is not liable for damage caused intentionally or by gross negligence of non-managerial personnel.
6.6 This warranty does not apply if: A) and for as long as the buyer is in default towards Trading Space / Sweet Collections; B) the buyer has repaired and/or processed the delivered goods themselves or has had them repaired and/or processed by third parties. C) the delivered goods have been exposed to abnormal conditions or have otherwise been treated carelessly or contrary to the instructions of Trading Space / Sweet Collections and/or the instructions for use on the packaging; D) the defect is wholly or partly the result of regulations that the government has imposed or will impose regarding the nature or quality of the materials used;

7. Offers
7.1 Offers are without obligation, unless otherwise stated in the offer.
7.2 If the buyer accepts a non-binding offer, Trading Space / Sweet Collections reserves the right to revoke or deviate from the offer within 3 working days of receipt of that acceptance.
7.3 Oral commitments only bind Trading Space / Sweet Collections after they have been expressly confirmed in writing.
7.4 Offers from Trading Space / Sweet Collections do not automatically apply to repeat orders.
7.5 Trading Space / Sweet Collections cannot be held to its offer if the buyer should have understood that the offer, or a part thereof, contained an obvious error or typo.
7.6 Additions, amendments and/or further agreements are only valid if agreed in writing.

8. Agreement
8.1 An agreement between Trading Space / Sweet Collections and a customer is concluded after an order has been assessed for feasibility by Trading Space / Sweet Collections.
8.2 Trading Space / Sweet Collections reserves the right to refuse orders or assignments without stating reasons, or to accept them only on the condition that shipment is made cash on delivery or after prepayment.

9. Images and specifications
9.1 All images, photos, drawings, etc., including data regarding weights, dimensions, colors, images of labels, etc., on the Trading Space / Sweet Collections website are approximate only, are indicative, and cannot give rise to compensation or termination of the agreement.

10. Force Majeure
10.1 Trading Space / Sweet Collections shall not be liable if and to the extent that its obligations cannot be fulfilled due to force majeure.
10.2 Force majeure means any external cause, as well as any circumstance that cannot reasonably be considered its risk. Delays or non-performance by our suppliers, internet disruptions, power outages, email disruptions, and disruptions or changes in technology provided by third parties, transportation difficulties, strikes, government measures, supply delays, negligence by suppliers and/or manufacturers of Trading Space / Sweet Collections, as well as by their assistants, illness of personnel, and defects in auxiliary equipment or means of transport are expressly considered force majeure.
10.3 In the event of force majeure, Trading Space / Sweet Collections reserves the right to suspend its obligations and is also entitled to terminate the agreement in whole or in part, or to demand that the content of the agreement be amended in such a way that performance remains possible. Under no circumstances is Trading Space / Sweet Collections obligated to pay any fines or damages.
10.4 If, upon the occurrence of force majeure, Trading Space / Sweet Collections has already partially fulfilled its obligations, or can only partially fulfill its obligations, it is entitled to invoice separately for the part already delivered or the part that can be delivered, and the buyer is obligated to pay this invoice as if it were a separate contract. This does not apply, however, if the part already delivered or the part that can be delivered has no independent value.

11. Liability

11.1 Trading Space / Sweet Collections is not liable for damage to vehicles or other objects caused by improper use of the products. Before use, read the instructions on the packaging and/or consult our website.

12. Retention of title
12.1 Ownership of all items sold and delivered by Trading Space / Sweet Collections to the purchaser shall remain with Trading Space / Sweet Collections as long as the purchaser has not paid the claims of Trading Space / Sweet Collections under the agreement or previous or subsequent similar agreements, as long as the purchaser has not yet paid for the work performed or yet to be performed under this or similar agreements and as long as the purchaser has not yet paid the claims of Trading Space / Sweet Collections due to failure to fulfill such obligations, including claims relating to fines, interest and costs, all as referred to in Article 3:92 of the Dutch Civil Code.
12.2 Items delivered by Trading Space / Sweet Collections that are subject to the retention of title may only be resold in the course of normal business operations and may never be used as a means of payment.
12.3 The purchaser is not authorised to pledge or otherwise encumber the items subject to the retention of title.
12.4 The purchaser hereby gives unconditional and irrevocable permission to Trading Space / Sweet Collections or a third party to be appointed by Trading Space / Sweet Collections to enter all items where its property is located and to take those items with it in all cases in which Trading Space / Sweet Collections wishes to exercise its ownership rights.
12.5 If third parties seize the goods delivered under retention of title or wish to establish or assert rights thereto, the purchaser is obliged to inform Trading Space / Sweet Collections as soon as can reasonably be expected.
12.6 The purchaser undertakes to insure and keep insured the goods delivered under retention of title against fire, explosion and water damage, as well as against theft, and to make the policy of this insurance available for inspection to Trading Space / Sweet Collections upon first request.

13. Applicable law/competent court
13.1 Dutch law applies to all agreements.
13.2 Disputes arising from an agreement between Trading Space / Sweet Collections and the buyer that cannot be resolved by mutual agreement will be heard by the competent court within the district of Trading Space Lederwaren BV's registered office, unless Trading Space / Sweet Collections prefers to submit the dispute to the competent court of the buyer's place of residence, and with the exception of those disputes that fall within the jurisdiction of the subdistrict court.

14. Terms and conditions for use of the Postpay option (if offered as a payment method)

14.1. You are a consumer residing in the Netherlands and, as a Customer of Trading Space / Sweet Collections, have purchased products and/or services with an invoice and delivery address (not a PO Box) in the Netherlands.
14.2. You are 18 years of age or older.
14.3. To limit the financial risks of this payment option, your order will be reviewed by an affiliated agency. Based on this review, Trading Space / Sweet Collections will determine whether it accepts your request for deferred payment. If not, you will be asked to pay for the order in advance using a different payment option.
14.4. You declare that all (additional) information required for your request for deferred payment has been provided correctly and completely, and you consent to the processing of your information and online verification of your information so that we can inform you immediately whether your request has been accepted.
14.5. You are obligated to inform Trading Space / Sweet Collections of any change of address and/or email address. Until we receive a change of address from you, you are deemed to be residing at the last address known to us. Regardless of whether you notify us of a change of address and/or email address, you remain obligated to pay any outstanding balance. Address and/or email address changes can be submitted via the Trading Space / Sweet Collections website, by email, or in writing to Trading Space / Sweet Collections Customer Service.
14.6. You declare that you have not applied for a moratorium or are in debt restructuring/mediation (in accordance with the Debt Restructuring (Natural Persons) Act), have not been declared bankrupt or placed under guardianship, and that there are no proceedings pending that could result in bankruptcy, a moratorium, or a placement under guardianship.

15. Post-payment option in general: payment method (if offered as payment method)
15.1. Trading Space / Sweet Collections has outsourced your payment processing. If your application is accepted, you will shortly receive an email with a payment link, in addition to the (digital) invoice, on behalf of or on behalf of Trading Space / Sweet Collections. Both the invoice and the email with the payment link will indicate how you should pay the invoice (after receiving the goods and/or services).
15.2. You acknowledge that the payment service offers services for the purpose of processing online payments from you to Trading Space / Sweet Collections and that in that regard the payment service displays and/or will display notices and communications and performs or will perform actions on behalf of Trading Space / Sweet Collections, which you also acknowledge as such as a valid and proper notice, communication and/or action by or on behalf of Trading Space / Sweet Collections.
15.3. The aforementioned invoice indicates how you should pay the invoice (after receipt of the goods and/or services). For your convenience, you will also receive an email from the payment service with a payment link, which you can use to pay the invoice. Always pay on time according to the instructions on the invoice or via the email with the payment link. This will prevent additional charges if the payment deadline is exceeded.
15.4. To receive the email with the payment link, it is important that you provide a correct email address. If you provide an incorrect email address, you will not receive payment information via the email with the payment link. You should therefore check the accuracy of your provided email address and ensure you receive an email with the payment link from the relevant payment service.

16. Post-payment option: payment terms and payment term
16.1. The amount due for your purchases must be received in full, without any deduction or settlement, by the relevant payment service within a period of fourteen (14) days after the invoice date.
16.2. If you have not paid the entire invoice amount within fourteen (14) days after the invoice date, you will be in default without further notice of default.
16.3. If the payment term is exceeded, Trading Space / Sweet Collections reserves the right to charge a fee for costs incurred in obtaining out-of-court settlement (surcharges). These surcharges may amount to the statutory maximum for costs incurred in obtaining out-of-court settlement (out-of-court collection costs). After charging surcharges, you must immediately pay the entire invoice amount, including the surcharge(s), to avoid further (out-of-)court collection costs.
16.4. The email address you provided, which you have verified is correct, will be used to send payment reminders and charge surcharges for late payment. You will receive an email with a payment link for this purpose. Failure to receive an email does not affect your responsibility to pay the entire invoice amount on time, including any surcharges.
16.5. If, despite formal notice and/or reminders, you do not pay the entire amount (invoice amount as well as surcharges), Trading Space Lederwaren will transfer the entire claim against you (principal amount as well as surcharges and otherwise) to the relevant payment service, in accordance with these general terms and conditions, thirty-five (35) days after the invoice date.
16.6. If a claim is transferred to the relevant payment service, in addition to paying the entire claim, you are also obligated to pay the statutory maximum compensation for costs incurred in obtaining satisfaction out of court (out-of-court collection costs) as well as (any) judicial collection costs. Statutory interest will also be due on the amount owed from the due date. After the transfer, the relevant payment service will contact you to discuss payment options, and you are and remain obligated to pay the amount owed.
16.7. After the claim has been transferred, you are obligated to inform the relevant payment service (or the collection agency engaged by it) of any change of address and/or email address during the period in which you are obligated to pay the amount due. As long as they have not received a change of address from you, you are deemed to be residing at the last address known to us and you remain obligated to pay the amount due at that time. You can notify the relevant payment service of any change of address and/or email address in writing. You can find the address details on the website under the logo of the relevant payment service.
16.8. If you fail to pay the entire amount (invoice amount and any surcharges), fail to pay it in full, or fail to pay it on time, this may affect any subsequent approval by the relevant payment service provider for any subsequent request for deferred payment.

17. Privacy Statement of the relevant payment service
By choosing the deferred payment option, the information you provide and your payment experience(s) will be included in the database of the relevant payment service. They may use this information, either statistically or otherwise, for credit assessment and acceptance of your application for the deferred payment option.
If you wish, you will receive written notification stating the reasons why the payment service in question rejected your request.

18. Cookies
18.1. The Trading Space / Sweet Collections website places cookies. Cookies are small text files that are placed on a PC, tablet, or mobile phone by a web page. These cookies are used to improve the functioning of the Trading Space / Sweet Collections website and to monitor website traffic, allowing Trading Space / Sweet Collections to determine how many people have visited the website in a given period. Trading Space / Sweet Collections uses this data only in aggregated form and cannot trace it back to a PC or individual.
18.2. Google Analytics is a web analytics service provided by Google Inc. These cookies provide Trading Space/Sweet Collections with insight into its website visits, including visitor numbers, popular pages, and topics. This allows Trading Space/Sweet Collections to better tailor its communications to the needs of its visitors. Trading Space/Sweet Collections cannot see who (which PC) visits its website. Google, as the service provider, can.
18.3. Social Media. If you are logged in to Facebook, Facebook can place cookies on your PC via Trading Space / Sweet Collections that are necessary for liking posts and updating your status.
